When my daughter was 12, I stopped my sister from having contact with my children as she was telling my 12 year old, she was abused, she wasnt loved and she needed to run away from home ( I found text messages) My sister has been no contact since then. A few weeks ago my daughter said she was staying with a friend and was taken by my sister 400 miles away. We called the police as we thought my daughter was a missing person untill we found out from her friends she had gone to England ( were from Scotland) to live with my sister. I called the police, who were useless and said that there was nothing they could do. And social services wont do anything. My daughter is from a loving home and until then we didnt know she was back in contact with my sister. Its obvious my sister has still been secretly contacting my daughter. Surely with evidence this is mental abuse? My daughter doesnt want to come home as she doesnt want to go to school and my sister has told her she doesnt need to. Ive been tearing my hair out for 3 weeks to try and get her back. My sister told the police I wasnt allowed on her property and has cut contact between myself and my daughter. I dont know where she is, who she is with or if she is even ok. I cant bare this anymore. I dont know what to do

Hi Melissa
I’m Lauren one of the parent supporters here on netmums. It sounds like things are really difficult with your sister and now your daughter is with them without your consent
Can I clarify a few things so that we can try and get you the right support.
Does your sister have parental responsibility of your daughter? At 15 legally an adult with parental responsibility needs to be involved in decisions about care. Is her father involved?
What reasons have police given that they cannot help?
Have you had any legal advice?
We are here if you want to talk some more
Have you contacted the police in England?
unsure why police and social work can’t help, as it’s her auntie; who has no PR. Like you say, she has abducted your daughter.
alternatively, you need to contact a family lawyer. Who can start proceedings for an emergency return of a child….court case usually happens very quickly. If the outcomes is ruled in your favour (zero reasons why it shouldn’t) unless sister and daughter say there is abuse; or make accusations. I do think in that case, and given she’s 15 they will look at this also. As her opinion/voice will be taken into consideration given she’s 15.
that being said, she is still a child, and shouldn’t be allowed to just swan off and start a new life whenever she wants.
are you close to your daughter? Is there a reason why she would rather be in England with her auntie opposed to at home with family in Scotland?
why has your sister been so desperate to get your daughter off you? Does she have children of her own? Are there maybe reasons why your daughter doesn’t want to Tinto school? Maybe bullying or struggling at school? It just seems all very odd.
my friend went through something similar, although it was dad who took child to England, and decided to start a new life with his new gf, and refused to return the wee one. She was only 2. He was on birth certificate, and obviously had PR. She contacted family lawyer in Glasgow who started proceedings for Emergency return of a child, court case was heard the following day. A social worker was then sent to check on the wee one’s welfare, and he was given a certain amount of time to return the child. (A few days) in the event he didn’t there would be a warrant for his arrest, and the child would have been removed by social services and returned to mum. The whole process took about a week in total.
